Staff Leasing vs Independent Contractor in Georgia: What Employers Should Compare

The commercial label should follow the real working relationship. Compare management, independence, payroll, risk and duration before choosing a model.

DIRECT ANSWER

Use a contractor model only where the relationship is genuinely independent. Use staffing or employment structures when the person is operationally embedded and the arrangement needs a clearer payroll, administration and continuity layer.

01

Start with independence and control.

A genuine contractor runs an independent service relationship. A staff member embedded into the client’s daily organisation may look operationally different, even if the invoice comes from an individual entrepreneur or company. Contract wording cannot change the underlying facts by itself.

02

Managed staffing adds an operating layer.

A staffing provider can handle agreed employment/contract administration, payments, candidate support and replacement processes while the client directs technical work within the defined boundary.

The value is not only payroll administration. A managed model can also provide a local contact for onboarding, workspace or hub coordination, equipment handover, absence follow-up and communication with the specialist when the client does not maintain its own local people-operations function.

03

Compare the models against the same questions.

Add two commercial questions as well: who carries the risk if the specialist is unavailable, and who is responsible for replacing or backfilling the capacity? Those answers can materially change the real cost of apparently similar rates.

  • Who sets working hours and priorities?
  • Who provides equipment?
  • Can the person serve multiple clients?
  • Who handles leave and absence?
  • Who pays and withholds local employment taxes?
  • How is termination/notice handled?
  • Who owns replacement and continuity risk?
04

Revisit the structure when duration changes.

A short specialist engagement can become a permanent embedded role. When that happens, re-evaluate employment, tax and management facts rather than allowing a temporary structure to persist automatically.

05

Contractor economics can look simple while operating reality is not.

A contractor invoice can appear administratively light, especially where the person operates as an individual entrepreneur. But the client should still understand who controls the work, whether the relationship is genuinely independent, how IP and confidentiality are handled and what happens if the person stops providing services.

The lowest administrative cost is not always the lowest operational risk.

06

Staffing models can provide continuity and administration.

A provider can centralise payment, documentation, candidate support, absence communication and replacement sourcing. This becomes more valuable when the client has several people in Georgia and does not want to build local operating processes immediately.

07

Compare flexibility in both directions.

Clients often focus on their ability to end or scale an engagement. Also consider the specialist’s notice, continuity of knowledge, provider replacement time and whether the client can convert the person to direct employment later under agreed terms.

A good commercial model supports change without creating surprises for either side.

08

Do not use a tax status as a substitute for classification analysis.

A person may qualify for a Georgian tax regime, but tax registration does not automatically determine whether the factual relationship is independent contracting for labour-law or client-country purposes. Treat tax, employment classification and commercial structure as related but distinct questions.

For longer-term teams, also compare whether creating a local Georgian entity or another permanent operating structure would eventually make more sense. That is a separate legal, tax and management decision and should not be assumed merely because headcount grows.

FAQ

Frequently asked questions

Is an individual entrepreneur automatically an independent contractor?

No. Tax registration does not by itself determine the legal nature of the working relationship. The actual facts and applicable laws matter.

Why might a company prefer staffing over direct contracting?

Staffing can centralise local administration, provide a consistent commercial relationship for multiple specialists and add continuity/replacement support. Whether that value is needed depends on the client’s own infrastructure.
